By accessing or using the Awaqen.ai website, platform, programs, or any related services (collectively, the "Services"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). 1. About Awaqen

Awaqen ("Awaqen", "we", "us", or "our") is a personal and professional growth platform founded and operated through awaqen.ai. Awaqen offers a proprietary GrowthOS Framework combining systems thinking, emotional intelligence, leadership development, and AI-assisted learning tools.

Awaqen is not a licensed therapy, counselling, or medical service. Our programs, content, and tools are designed for personal development and professional growth purposes only.

2. Eligibility & Account Registration

2.1 Who May Use Our Services

To access the Awaqen platform you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction

• Have the legal capacity to enter into a binding agreement

• Not be prohibited from using our Services under any applicable law

2.2 Account Creation

You are required to create an account to access certain features of our platform. When registering you agree to:

• Provide accurate, current, and complete information

• Maintain and promptly update your account information

• Keep your password confidential and not share it with third parties

• Notify us immediately at contact@awaqen.ai of any unauthorised use of your account

You are solely responsible for all activities that occur under your account. Awaqen reserves the right to suspend or terminate accounts found to be providing false information or operating in violation of these Terms.

3. Programs, Services & Subscriptions

3.1 Platform Offerings

Awaqen offers a range of programs, challenges, AI-powered tools, reports, and subscription plans (collectively, "Programs"). Specific features available to you depend on your selected subscription tier or individual purchase.

3.2 AI-Powered Features

Awaqen utilises artificial intelligence to generate personalised growth reports, insights, and recommendations. You acknowledge and agree that:

• AI-generated content is informational and educational in nature

• AI outputs do not constitute professional medical, psychological, legal, or financial advice

• Results may vary and are not guaranteed

• You retain responsibility for any decisions made based on AI-generated insights

3.3 Subscription Terms

Certain features require a paid subscription. By subscribing you agree to:

• Pay all applicable fees as set out on our pricing page

• Automatic renewal of your subscription at the end of each billing period unless cancelled

• Our right to modify pricing with reasonable advance notice

3.4 Tokens & Digital Credits

Awaqen may offer a token or credit system for accessing certain features. Tokens are non-transferable, have no cash value, cannot be exchanged for currency, and expire in accordance with the applicable token policy displayed on your account dashboard.

4. Payments, Billing & Refunds

4.1 Payment Methods

We accept payment via major credit and debit cards and other payment methods as may be displayed at checkout. All transactions are processed through secure third-party payment processors. Awaqen does not store your payment card details.

4.2 Billing

Fees are charged in advance at the start of each billing cycle. You authorise us to charge your selected payment method automatically at each renewal date. If payment fails, we reserve the right to suspend access to your account until payment is successfully processed.

4.3 Refund Policy

Due to the digital and AI-generated nature of our programs and reports, all sales are generally final. However, we offer the following:

• Program refund requests submitted within 7 days of purchase, where no sessions, reports, or significant platform features have been accessed, may be considered at Awaqen's sole discretion

• Subscription fees for upcoming billing periods may be cancelled before the renewal date with no further charge — no refund is provided for the current active period

• Technical faults or service failures attributable solely to Awaqen may entitle you to a pro-rated credit or refund

To request a refund, contact us at contact@awaqen.ai with your order details and reason for the request.

5. Acceptable Use

You agree to use the Services only for lawful purposes and in a manner consistent with these Terms. You must not:

• Use the platform for any unlawful, fraudulent, or harmful purpose

• Attempt to gain unauthorised access to any part of the platform, servers, or networks

• Reproduce, distribute, resell, or sublicense any platform content or AI-generated outputs without our express written consent

• Upload or transmit any content that is defamatory, obscene, abusive, threatening, or infringes any third-party rights

• Use automated tools, bots, scrapers, or scripts to access, extract, or interact with the platform

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

• Interfere with or disrupt the integrity or performance of the Services

Awaqen reserves the right to investigate and take appropriate action — including account suspension or termination — against any user who violates these provisions.

6. Intellectual Property

6.1 Awaqen's Content

All content on the Awaqen platform — including but not limited to the GrowthOS Framework, program materials, AI models, reports, branding, logos, text, graphics, and software — is the exclusive intellectual property of Awaqen and its licensors, protected by applicable copyright, trademark, and intellectual property laws.

6.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform content solely for your personal, non-commercial growth and development purposes. This licence does not permit you to copy, modify, distribute, sell, or create derivative works from our content.

6.3 Your Content

If you submit, upload, or share content on the platform (such as reflections, responses, or profile information), you grant Awaqen a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely to provide and improve the Services. You retain ownership of your content.

6.4 AI-Generated Reports

Reports and insights generated by Awaqen's AI system based on your inputs are provided to you for personal use. You may not redistribute, sell, or publish AI-generated reports without prior written consent from Awaqen.

7. Privacy & Data Protection

Your use of the Services is also governed by our Privacy Policy, available at www.awaqen.ai/privacy, which is incorporated into these Terms by reference. By using the Services you consent to the collection, processing, and use of your personal data as described in the Privacy Policy.

We implement industry-standard security measures to protect your data. However, no method of transmission over the internet is 100% secure and we cannot guarantee absolute security.

Awaqen operates in compliance with applicable data protection laws. Where required, we will obtain appropriate consent for the processing of personal data.

8. Disclaimers & Limitation of Liability

8.1 Not a Substitute for Professional Advice

The Services, including all AI-generated content, program materials, and growth frameworks, are provided for educational and personal development purposes only. Nothing on the Awaqen platform constitutes medical advice, psychotherapy, psychological counselling, legal advice, or financial advice. Always seek the advice of qualified professionals for matters of health, mental wellness, law, or finance.

8.2 No Guarantees of Outcomes

Personal growth and transformation are deeply individual processes. Awaqen makes no representations, warranties, or guarantees regarding specific outcomes, results, or changes in your personal or professional life arising from use of the Services.

8.3 Platform Availability

Awaqen does not warrant that the Services will be uninterrupted, error-free, or free from technical issues. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

8.4 Limitation of Liability

To the fullest extent permitted by applicable law, Awaqen and its founders, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Services, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed the amount you paid to Awaqen in the 3 months preceding the event giving rise to the claim.

9. Account Suspension & Termination

Awaqen reserves the right to suspend or permanently terminate your account and access to the Services, with or without notice, for any of the following reasons:

• Violation of these Terms or any applicable law

• Conduct that Awaqen reasonably believes is harmful to other users, third parties, or Awaqen

• Non-payment of applicable fees

• Provision of false or misleading information during registration

• Inactivity for an extended period, as determined by Awaqen

You may cancel your account at any time by contacting us at contact@awaqen.ai. Upon termination, your right to access the Services ceases immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability provisions — shall survive.

10. Third-Party Services & Links

The platform may contain links to third-party websites or integrate with third-party services (including payment processors, social media platforms, and AI infrastructure providers). Awaqen does not control and is not responsible for the content, privacy practices, or terms of any third-party service.

Your interaction with third-party services is governed solely by those parties' terms and policies. We encourage you to review the terms and privacy policies of any third-party services you access through or in connection with our platform.

11. Modifications to These Terms

Awaqen reserves the right to update or modify these Terms at any time. When we make material changes, we will:
